1. About these terms
These terms apply to the website cactuslap.ae, including its Arabic version, which is published by CACTUSLAP CONTRACTING L.L.C, trading as Cactus Landscaping & Pools, a company licensed in Dubai, United Arab Emirates (trade license no. 1241098), with its office in Business Bay, Dubai. In these terms, “we,” “us” and “Cactus” mean that company, and “the website” means cactuslap.ae.
By using the website you accept these terms. If you do not accept them, please do not use the website. They cover the website only. Any work we do for you is governed by a separate written agreement, and nothing on the website changes that agreement or forms part of it.
2. Using the website
You may browse the website, read its content, and use the forms and contact details to ask us about a project. The website is intended for adults; if you are under 18, please ask a parent or guardian to contact us on your behalf.
You may not use the website in a way that damages it or interferes with anyone else’s use of it. That includes attempting to gain access to areas of the website you are not meant to see, introducing malicious code, copying the website or its content by automated means such as scraping or crawling, and submitting the forms with false information, spam, or anything other than a genuine enquiry about our work. The forms are not to be used to offer us goods or services, and we do not respond to solicitations sent through them.
3. Content and intellectual property
Everything on the website belongs to Cactus: the text, the photographs, the design drawings and 3D renders, the logo and icons, and the way it is all arranged. It is protected by copyright and trademark law in the UAE and internationally.
You may view the website and share links to its pages. You may not copy, download, reproduce, publish, distribute, alter, or create anything derived from its content without our written permission, whether for commercial use or not. That includes using our photographs or renders on another website or in social media, in a presentation or a proposal, or as material for training software or artificial intelligence systems. The Cactus name and logo may not be used without our written consent.
4. People and homes shown on the website
The photographs on the website show real places and real people: our team at work, the owner of the company, and the gardens and pools of private villas we have designed and built, before, during and after construction. They are published with the permission of the people and homeowners concerned, for the single purpose of showing our work.
Please treat them accordingly. Do not use them to identify or locate any property or person, do not contact a homeowner or a member of our team on the basis of what you see here, and do not republish them anywhere. Where a project page says a garden can be visited by arrangement, that is an invitation to ask us, not a right to visit: every visit depends on our agreement and the homeowner’s, and either may decline or withdraw at any time.
5. Information, not a quotation
The website describes what we do and shows work we have done. It is general information, published in good faith, and it is not an offer, a quotation, or advice for your particular project. Every garden is different, and what we would build for you, at what cost and in what time, can only be established after we have seen your villa and prepared a written quotation.
The warranties mentioned on the website, such as the 10-year warranty on the pool structure, describe what our contracts normally include. They apply only to work carried out under a signed agreement with us, on the terms set out in that agreement. Each project page describes that one project, and nothing on it promises that another project will look the same, use the same materials, or take the same time.
6. Enquiries
Sending a form, a message or an email through the website is a request for us to contact you. It does not place an order and does not create a contract. We will do our best to reply within the time shown on the website, but that is an aim rather than a commitment, and we may decline an enquiry at our discretion, for example where a project is outside the work we do.
Anything you send us through the website should be your own information, and you are responsible for its accuracy. How we handle it is explained in our Privacy Policy, which forms part of these terms.
7. Reviews, social media and third-party links
The reviews displayed on the website are drawn from our Google Business Profile and reflect the opinions of the people who wrote them, in their own words. We do not edit them, and they are not statements by us. The Instagram posts shown are ours, displayed from our own account.
The website links to other websites and services, including Google, Instagram, Facebook, LinkedIn and WhatsApp. We do not control those services and are not responsible for their content, their availability, or how they handle your information. Following a link is your decision, and their terms and policies apply once you leave our website.
8. Availability and accuracy
We try to keep the website accurate, current and available, but we do not promise that it will be. We may change, remove or add content at any time without notice, and the website may occasionally be unavailable for maintenance or for reasons outside our control.
If you notice something on the website that is wrong or out of date, we would be glad to hear from you.
9. Liability
The website is provided as it is. To the extent permitted by UAE law, we accept no liability for any loss or damage arising from your use of the website or from reliance on its content, including loss caused by errors or omissions, by the website being unavailable, or by the content of any website we link to.
Nothing in these terms excludes or limits any liability that cannot be excluded or limited under the laws of the United Arab Emirates.
10. Governing law, language and contact
These terms are governed by the federal laws of the United Arab Emirates and the laws of the Emirate of Dubai, and any dispute about them will be dealt with by the courts of Dubai. They are published in English and Arabic. The English version is the original, and if the two differ, the English version applies.
We may update these terms when the website changes. The date at the top of the page shows when they were last revised, and the version published here is the one in force. Questions about these terms can be sent to info@cactuslap.com or +971555237007.
